General Terms and Conditions «Vinichill»

 

 

1. Scope of the GTC

 

The following general terms and conditions (GTC) apply to all purchases of Vinichill products. The GTC are based on Swiss law and apply in Switzerland and abroad, provided that the parties expressly or tacitly recognize them. 

 

Changes and ancillary agreements are only effective if agreed in writing by both parties.

 

2. Contracting Party

hereinafter referred to as «Vinichill», the contract is concluded.

 

3. Subject of the contract

 

This contract regulates the offer and sale of products and services through the Vinichill website. For details of the respective offer, reference is made to the product description on the offer page.

 

4. Conclusion of contract

 

The contract is concluded in electronic business transactions on this website, via other means of distance communication such as telephone and e-mail or in a personal conversation.

 

The ordering process and contract conclusion on this website include the following steps:

 

  • Choice of product or service

  • Enter the necessary and requested personal data

  • Review and processing of the order and all entries

  • Pressing the button "Order with costs"

  • Payment for the service in advance using the means of payment made available for online purchases

5. Duration of Contract

 

A contract is only concluded for one order. For each subsequent order, a new contract will be concluded between Vinichill and the customer.

 

6. Liability

 

Vinichill assumes no responsibility for the correctness, accuracy, timeliness, reliability and completeness of the information on this website. Liability claims against the author for material or immaterial damage resulting from access to, use or non-use of the published information, misuse of the connection or technical faults are excluded. All offers are non-binding. The author expressly reserves the right to change, supplement or delete parts of the pages or the entire offer without prior notice or to temporarily or permanently discontinue publication.

 

All products are unique and handmade. Deviations from the pictures and other products are of course possible. There is no guarantee that each product is identical to another. The boxes of wine shown are examples, the customer has no right to insist on a specific design (brand, winery, etc.) for exactly the products seen in the pictures or elsewhere. Vinichill uses the boxes present at the time of the order. Customer requests will be accommodated as far as possible, but these cannot be guaranteed unless the customer delivers the wine crate to Vinichill for further processing.

 

7. Confidentiality and Privacy

 

This is regulated in detail in our data protection declaration. We also assure our customers that we are subject to confidentiality and will not pass on any data or personal information to third parties. We also use technical means to protect our customers' data from misuse.

 

8. Terms of Payment

 

The customer pays in advance on the website using the means of payment made available.

 

9. Warranty

 

If a product is delivered with obvious defects, the customer is entitled to have the defects rectified, provided these are of a technical nature and do not relate to the condition of the wine crates. We work with wood that can change color or break if it is treated improperly, for example if it is exposed to moisture. We cannot accept any liability for any damage resulting from obviously improper use of our products.

11. Language, Jurisdiction and Applicable Law

 

Swiss law applies. The place of jurisdiction for disputes arising from these General Terms and Conditions is Zug / Switzerland.

 

12. Severability Clause

 

The invalidity of a provision of these terms and conditions has no effect on the validity of the other provisions. The invalid provision will then be replaced by a regulation that comes as close as possible to the meaning of the invalid provision.
